HOW
DID WE GET INTO THIS BUSINESS? The
principals of LIEN ON US, LLC have been in the commercial and
residential building businesses two decades. About 4 years ago, we
began to notice that our building business cash flow and the cash
flows of other contractors and building suppliers were coming under
stress due to accelerating
numbers
of owner’s disputing progress billings either because they were
having financial difficulties affecting their ability to pay, or
just because they were plain alleging questionable construction
defects which were within the Registrar’s standards. But
most owners didn’t and still don’t know the provisions of
Arizona’s prompt pay provisions meant to protect contractors as
well as owners [A.R.S. § 32-1129.01 (D)].
In
today’s slowing building and real estate environment it is
becoming increasingly difficult for builders and their suppliers, as
well as building service professionals, to collect their money and
get on with the next deal. Quite often these days, these collection
difficulties lead to lawsuits in attempts to foreclose mechanic’s
liens, followed by counter-lawsuits by owners alleging construction
defects, deviation from prints and specs, or accounting
